TERMS AND CONDITIONS OF SERVICE

ARTICLE 1: LEGAL BINDING & DEFINITIONS

1.1. Agreement to Terms: These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” “User,” or “Client”) and SELFIYA, founded and operated by Pinky Shelshiya (“Company,” “we,” “us,” or “our”), concerning your access to and use of the selfiya.com website, the SELFIYA Android Application Package (APK), and all associated conversational commerce channels, including but not limited to WhatsApp, Instagram, and Email.

1.2. Acceptance: By accessing the Site or the App, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE OR THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1.3. Definitions: * "Curation Services" refers to the selection and recommendation of third-party apparel and beauty products.

"Direct Sales" refers to natural, Ayurvedic, or wellness products sold directly by SELFIYA.
"Conversational Commerce" refers to the transaction flow occurring via mobile messaging applications.

ARTICLE 2: INTELLECTUAL PROPERTY RIGHTS

2.1. Ownership: Unless otherwise indicated, the Site, the App, and the Tagline "Styling the Best Version of You" are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by Pinky Shelshiya.

2.2. License: No part of the Site, App, or Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

ARTICLE 3: THE CONVERSATIONAL COMMERCE PROTOCOL

3.1. Non-Automated Checkout: The User acknowledges that SELFIYA does not utilize an automated digital shopping cart. All commercial transactions are governed by a human-to-human verification process. 3.2. Order Confirmation: No contract for sale exists until:

The User specifies a product via WhatsApp.
SELFIYA confirms stock availability and current pricing.
The User submits payment via UPI or specified bank transfer.
SELFIYA issues a "Payment Received" confirmation message. 3.3. Pricing Errors: We reserve the right to cancel any order initiated via WhatsApp if there is a typographical error in the listed price on the website or marketing materials.

ARTICLE 4: APK & MOBILE APPLICATION EULA

4.1. License Grant: We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the SELFIYA Android APK strictly for personal, non-commercial purposes. 4.2. Restrictions: You shall not decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the application. 4.3. Updates: We may from time to time provide upgrades or updates to the application, which may be required to continue using the service.

ARTICLE 5: LIABILITY LIMITATIONS (STRICT CAP)

5.1. General Liability: To the fullest extent permitted by law, in no event will SELFIYA or Pinky Shelshiya be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages. 5.2. Monetary Cap: Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to:

₹1,500.00 (One Thousand Five Hundred INR) for all claims related to physical product quality or delivery.
₹500.00 (Five Hundred INR) for all claims related to digital consultations, styling advice, or website downtime. 5.3. External Links: We bear zero liability for products purchased via affiliate links. Those transactions are governed solely by the terms of the third-party merchant.

ARTICLE 6: WELLNESS & AYURVEDIC DISCLAIMER

6.1. Lifestyle Only: All natural and Ayurvedic products are sold as lifestyle and beauty enhancements. They are not pharmaceutical drugs. 6.2. Medical Advice: The information provided by SELFIYA is for educational purposes only and is not intended as medical advice. You should always consult with a qualified healthcare professional before beginning any new wellness regimen. 6.3. Allergic Reactions: It is the User's sole responsibility to check ingredients. SELFIYA is not liable for allergic reactions, skin sensitivities, or adverse effects.

ARTICLE 7: SHIPPING, RETURNS & INTERNATIONAL POLICY

7.1. WhatsApp Finality: Since products are curated and confirmed via WhatsApp interaction, all sales are considered Final once the shipping label is generated. 7.2. International Assistance: SELFIYA does not operate as a licensed international exporter. Any shipments requested outside of India are facilitated as "Personal Assistance/Private Favors." The User acts as the "Importer of Record" and is responsible for all local laws and customs duties. 7.3. Return Exceptions: Returns are only considered in cases of "Wrong Product Received" and must be supported by an unboxing video.

ARTICLE 8: INDEMNIFICATION

You agree to defend, indemnify, and hold Pinky Shelshiya and SELFIYA harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) breach of these Terms of Use; (3) your violation of the rights of a third party, including but not limited to intellectual property rights.

ARTICLE 9: GOVERNING LAW & MANDATORY ARBITRATION

9.1. Governing Law: These Terms and your use of the Site/App are governed by and construed in accordance with the laws of India. 9.2. Venue: Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted exclusively in the courts of Vellore, Tamil Nadu, India, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such courts.

ARTICLE 10: USER DATA & SPAM COMPLIANCE

10.1. Outreach: We utilize "Cold Outreach" methods via WhatsApp and Email. By using our platform, you acknowledge our right to contact you. 10.2. Opt-Out: You may opt-out of marketing communications at any time by replying "STOP" on WhatsApp or clicking "Unsubscribe" in emails. Such requests will be processed within 48 business hours.
